Any statements or descriptions contained in the website, bill of sale, invoice, or elsewhere are qualified statements of opinion only and are not representations or warranties. Specifically, any description of manufacturer, artisan authorship, period, culture, source, origin, measurement, quality, condition, rarity, provenance, importance, historical relevance, physical condition or authenticity are qualified statements of opinion only and are not representations or warranties.
Items for sale are antique and will exhibit wear, tear, imperfections or the effects of aging. It is recommended that all customers carefully examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity and description, we recommend you have an expert examine and research the item(s) for you in advance of purchase.
Churchill’s makes no representations or warranties that the Services are free of defects, viruses, or other harmful components. Churchill’s shall not be responsible for any damages or loss that may result from the hacking or infiltration of the Services. You have the sole responsibility for adequate protection and backup of data and/or equipment used in connection with the Services.
You agree to hold Churchill’s harmless from, and you covenant not to sue Churchill’s for, any claims based on the use of the Services, including claims for lost data or lost profits resulting from use of the services provided. Churchill’s disclaims all representations and warranties of any kind, express or implied, or statutory, not expressly set out in these terms, including without limitation implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, Churchill’s makes no representation, warranties, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Services, or that the Services will be uninterrupted or error-free. Churchill’s does not guarantee the quality, suitability, or safety of the information provided to you. You agree to assume the risk arising out of your use of the Services. This risk remains solely with you, to the maximum extent permitted under applicable law.
LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES SHALL CHURCHILL’S, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PROPERTY DAMAGE, OR ANY OTHER DAMAGE WHATSOEVER IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF CHURCHILL’S HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES; CHURCHILL’S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW. CHURCHILL’S SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF YOUR USE OF OR RELIANCE ON THE SERVICES OR YOU INABILITY TO ACCESS OR USE THE SERVICES.
CHURCHILL’S TAKES ALL POSSIBLE STEPS TO ENSURE THE QUALITY, AUTHENTICITY, SAFETY AND LEGALITY OF ITEMS ADVERTISED BUT DOES NOT PROVIDE ANY GUARANTEES; CHURCHILL’S WILL NOT KNOWINGLY SELL ANY ITEM THAT HAS BEEN “REPAIRED”, “RESTORED”, “PROCESSED”, “CLEANED”, “PRESSED”, OR “CONSERVED” IN ANY WAY WITHOUT DISCLOSURE OF SUCH FACTS TO THE POTENTIAL BUYER.
THE LIMITATIONS AND DISCLAIMERS IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
INDEMNITY:
You will indemnify and hold harmless Churchill’s and its subsidiaries, affiliates, licensors, service providers, employees, agents, officers and directors, from and against any and all claims, demands, losses, liabilities, and expenses (including legal fees), arising out of or in any way connected with:
(a) your access to, use of, or alleged use of the Services or the services or goods obtained through your use of the Services;
(b) your breach or violation of any of the Terms, representations, warranties, or agreements referenced in the Terms, or any applicable law of regulation; or
(c) Churchill’s’ use of your information provided by you in your Account.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter). In such an event, you agree to cooperate with our defense of that claim.
PRIVACY: Your privacy is important to us. Churchill’s will use all commercially reasonable efforts to ensure the privacy and security of your data and Account information. When you use the Services, Churchill’s may collect personal data, including but not limited to, name, date of birth, e-mail, postal addresses, telephone number(s), product interest information, and payment details such as, but not limited to, credit card information. (“Personal Data”). This

PAYMENT: Churchill’s allows payment via Paypal or Stripe.
TAX: Customers will be responsible to pay applicable sales taxes.
SHIPPING INFORMATION: Churchill’s Antiques will, by default, ship USPS Priority Mail with tracking, signature confirmation and insurance in the amount of the purchase price. Please email us at Service@churchillsantiques.com if you prefer alternative shipping arrangements. All items will be shipped within 7 business days of payment. Successful international Bidders shall provide written shipping instructions, including specified customs declarations, to Churchill’s Antiques for items to be delivered outside of the United States. NOTE: Declaration value shall be the item(s) purchase price. On all foreign shipments, any risk of loss during shipment shall be borne by the Purchaser following Churchill’s Antiques’ delivery to the common carrier or other third-party shipper. All items will be shipped with insurance and signature confirmation and Churchill’s Antiques will not assume any liability once the item has been shipped or is in the possession of the common or third party carrier. If the client has a signature release on file with the carrier, then the package will be considered delivered by Churchill’s Antiques once it is in the possession of the third party carrier.
RETURNS: Churchill’s Antiques provides a “No Questions Asked” Return Policy. All items and lots purchased from Churchill’s can be returned for a refund only if the following criteria are met:
- Churchill’s Antiques must be notified of your intent to return via email (service@churchillsantiques.com) within 7 days after your order is received.
- All items must be received in the same condition as at the time of purchase. Cleaning, disassembly, or tampering with the purchased item will void the return policy.
- The buyer will assume responsibility and risk for return shipping. All returns must be shipped with online tracking and insurance in the amount of the purchase price.
